By engaging my services, submitting a project brief, or accessing this website, you agree to comply with and be bound by the following Terms of Service. If you do not agree with any part of these terms, please do not use this site or contract services.
1.1 Scope of Services
I provide professional web design, front-end development, full-stack WordPress engineering, WooCommerce e-commerce development, speed and Core Web Vitals optimization, site audits, and ongoing website maintenance (“Monthly Site Care”). Each project scope, schedule, deliverable, and milestone estimate is outlined and agreed upon in a written project proposal or statement of work prior to kickoff.
1.2 Project Milestones & Payment Terms
- Retainer / Deposit: A deposit (typically 50% unless otherwise agreed in writing) is required to secure project scheduling and commence architecture, wireframing, or design sprints.
- Milestone Payments: Projects with multiple phases may require interim progress payments upon completion of specified deliverables (e.g., design approval, core development).
- Final Settlement & Handover: The final balance is due upon project completion, quality assurance testing, and prior to final domain DNS cutover or delivery of administrator credentials.
- Late Payments: Unpaid invoices exceeding 14 days may result in paused development or delayed launch timelines until the balance is settled.
1.3 Intellectual Property & Asset Ownership
- Client Ownership: Upon full and final settlement of all project invoices, the client receives full ownership of all custom design files, custom theme templates, bespoke code, and content created specifically for the project.
- Open-Source & Third-Party Software: WordPress core, open-source plugins, and libraries remain governed by their respective licenses (e.g., GNU General Public License v2+). Any third-party commercial premium licenses (e.g., Elementor Pro, Crocoblock) must be maintained by the client unless bundled in an active Monthly Site Care plan.
- Portfolio Rights: Unless explicitly restricted by a signed Non-Disclosure Agreement (NDA) prior to kickoff, I reserve the right to feature completed projects, screenshots, case studies, and live links in my professional portfolio, design case studies, and marketing materials.
1.4 Client Responsibilities & Materials
To ensure projects launch on schedule, clients agree to provide necessary branding assets, copy, product data, access credentials, and feedback in a timely manner. Delays in providing required feedback or materials exceeding 21 days without prior notification may result in rescheduling the project queue.
1.5 30-Day Post-Launch Warranty
Every custom website build includes a complimentary 30-day post-launch warranty. During this window, any bugs, broken styling, or functional issues arising directly from the original agreed scope of work are addressed and resolved at no extra charge. This warranty does not cover issues introduced by subsequent client edits, third-party plugin additions, or server host disruptions occurring after launch.
1.6 Limitation of Liability
While every website is built to high standards of security, speed, and reliability, Tobi John shall not be held liable for indirect, incidental, or consequential damages resulting from third-party server hosting downtimes, security breaches caused by insecure client credentials, or changes in third-party APIs (e.g., payment gateways, social media integrations).
2. Privacy Policy
Your privacy and the security of your business information are paramount. This Privacy Policy outlines how personal and business data is collected, used, and protected when you interact with Tobi John.
2.1 Information Collected
I only collect information reasonably necessary to evaluate project feasibility, deliver contracted web services, and provide customer support:
- Project Intake Form Data: Your name, work email address, WhatsApp / phone number, estimated project budget, and project brief details submitted via the contact form.
- Technical & Preference Cookies: A local storage key (
tj-theme) used strictly to preserve your preferred viewing mode (Light or Dark) across visits. No personal identification data is stored. - Anonymized Server Telemetry: Standard server logs (browser user-agent, IP address, access timestamp) utilized for caching efficiency, spam prevention, and server security.
2.2 How Your Information Is Used
Your information is used strictly to:
- Respond to your project inquiry with feasibility insights, timelines, and cost estimates.
- Coordinate communications via email or WhatsApp during active design and development sprints.
- Issue invoices, contracts, and deliver final administrative handover materials.
I do not sell, rent, trade, or distribute your personal or business information to third-party marketing companies or data brokers under any circumstances.
2.3 Data Storage & Security
All communication channels and digital platforms utilize modern encryption standards (TLS/HTTPS). Any server credentials or database keys shared during development are stored in encrypted credential vaults and discarded or rotated upon project handover.
2.4 Third-Party Integrations
This website interacts with select trusted third-party providers:
- WhatsApp (Meta): Optional one-click chat initiation for instant project communication. WhatsApp’s handling of messages is governed by their independent privacy policy.
- Cloudflare & LiteSpeed: Used for edge caching, DDoS protection, and SSL termination.
- Payment Gateways (Paystack / Stripe): Direct client invoicing and deposits are handled through certified, PCI-compliant payment gateways. No credit card numbers are ever stored on this website.
